Welcome to Evrgreen. By accessing or using our website, placing an order, or renting décor items from Evrgreen, you agree to be bound by the following Terms of Service (“Terms”). If you do not agree to these Terms, you may not use our services.

1. Services

Evrgreen provides seasonal décor rental services and related products. All items rented through Evrgreen remain the sole property of the Company at all times.

2. Eligibility

By using our services, you represent that you are at least 18 years of age and capable of entering into a legally binding agreement.

3. Rental Period

Rental periods begin on the delivery date and end on the specified return date outlined in your order confirmation. Customers agree to return all rented items by the stated return deadline using the method provided by Evrgreen.

4. Care & Use of Items

Customers agree to use all rented décor items in a reasonable and intended manner. Items may not be altered, modified, subleased, or used for commercial purposes without prior written consent.

5. Fees & Charges

You authorize Evrgreen to charge the payment method on file for rental fees, late fees, replacement costs, or other charges incurred under these Terms, including those related to lost, damaged, or unreturned items. If you don't have payment on file, we will send you an invoice and you agree to pay invoice within 21 days of receiving it.

6. Assumption of Risk

Use of rented décor items is at the customer’s own risk. Evrgreen is not responsible for any injuries, damages, or losses arising from the use, placement, or handling of rented items.

7. Limitation of Liability

To the fullest extent permitted by law, Evrgreen shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of our services or products.

8. Intellectual Property

All website content, branding, designs, photography, and written materials are the intellectual property of Evrgreen and may not be copied, reproduced, or used without permission.

9. Modifications

Evrgreen reserves the right to update or modify these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles.

Returns & Damage Policy

Returns

All rented items must be returned by the return date listed in your order confirmation. Items must be packed with reasonable care, using the original packaging materials whenever possible.

Failure to return items by the designated return date may result in late fees or replacement charges.

Normal Wear & Tear

Normal wear and tear is expected and accepted. This includes minor scuffs, light use marks, or natural aging consistent with appropriate seasonal décor use.

Damage Policy

We understand accidents happen. Our policy allows for one accidental damaged item per order at no additional charge.

Damage beyond normal wear and tear, multiple damaged items, missing items, or items deemed unusable will result in a replacement fee equal to the retail value listed on the item tag or order documentation.

Lost or Unreturned Items

Any items not returned within five (5) days of the return deadline will be considered lost and charged at full replacement value.

Inspection & Charges

All items are inspected upon return. If additional charges apply, customers will be notified and the payment method on file will be charged accordingly.
